Delegation Agreement
The European Union, represented by the European Commission, on the one part, and SIEA (Slovak Innovation and Energy Agency) as the National Agency on the other part executed the Delegation agreement on 10.08.2016. The agreement was filed in the Central register of contracts the same date and the agreement became effective on 11.08.2016.
In line with Article 5(2) of Council Regulation (EURATOM) no 1368/2013 of 13 December
2013, Articles 1(2) and 23 of Commission Implementing Decision C(2014)5449 of 7 August 2014, and Article 1(3) of Commission Implementing Decision C(2015)5211 of 30 July 2015 ("Financing Decision") and in due consideration of Regulation (EU, Euratom) No 966/2012 of 25 October 2012, the Commission has decided to entrust budget implementation tasks to the National Agency under the Bohunice Programme.
The purpose of the Delegation agreement is to define the entrusted tasks, to lay down the rules applicable to their implementation and to define the rights and obligations of the parties in their implementation.
Delegation Agreement is subject to:
- the positive outcome of the ex-ante assessment of the National Agency pillars conducted by the Commission.
- the positive outcome of the ex-post assessment of the National Agency pillars conducted after the first full year of implementation of the entrusted task by SIEA, with the objective to provide reasonable assurance as to whether SIEA fulfils the requirements set out in Article 60.2 of the Financial Regulation applicable to the general budget of the Union.
Responsibilities of the National Agency in the field of:
Programming and monitoring
Responsibilities of the National Agency related to programming and monitoring of the V1 NPP decommissioning project implemented via National agency.
Preparation of Projects
Conduct preparatory activities for the implementation of projects, (oversight of preparation of project identification fiches), amendments of the project identification fiche. Grant allocations for financing of respective decommissioning projects and their execution through Grant agreements.
Implementation
All projects shall be implemented by means of contracts under applicable Union legislation on public procurement and the Law on Public Procurements of the Republic of Slovakia except where the actions concerned are eligible for grant funding.
Implementation of Projects
Ensuring that implementation of projects is, at all times, strictly according to the provisions of the Commission-approved project identification fiches. Verifying and certifying authority for all costs incurred under financing agreements. Make payments as specified in financing agreements against invoices.
